Prosecutors handling former U.S. President Donald Trump’s classified documents case have requested a federal judge to restrict Trump from making statements that could endanger law enforcement, according to a court document filed on Friday.
Special Counsel Jack Smith, in a motion to modify Trump’s release conditions, argued that this measure is necessary due to “several intentionally false and inflammatory statements” made recently by Trump. These statements, Smith claims, distort the circumstances surrounding the FBI’s search warrant execution at Mar-a-Lago.
Smith’s filing to U.S. District Judge Aileen Cannon, who was appointed by Trump, described the comments as “grossly misleading.” He emphasized that the law enforcement agents involved in the August 2022 search of Trump’s estate acted “appropriately and professionally.”
Trump, the Republican contender against Democratic President Joe Biden in the upcoming November 5 election, falsely claimed in recent fundraising messages that the FBI was authorized to attempt an assassination.
“Trump’s repeated mischaracterization of these facts, framing them as an assassination attempt on him, his family, and Secret Service agents, has endangered the law enforcement officers involved in this case and threatened the integrity of these proceedings,” Smith wrote. He also noted that restricting such future statements would not impede legitimate speech.
The FBI’s search of Trump’s Mar-a-Lago resort aimed to retrieve classified materials that Trump retained post-presidency. This search uncovered numerous records, leading to 40 counts of illegal retention of sensitive national security documents.
This case is one of four criminal prosecutions Trump is facing. He has pleaded not guilty to all charges, alleging that these prosecutions are part of a politically motivated “witch hunt” to prevent his return to the White House.
Prior to the Mar-a-Lago search, the FBI had a policy statement, released this week, authorizing the use of deadly force only if there was an immediate threat to an officer or another person. Trump was not present during the search.
Attorney General Merrick Garland, who oversees the FBI, stated that such policies are routine and were also in effect during consensual searches of President Biden’s homes in a separate classified documents investigation.
